1. PURPOSE OF THE PRIVACY POLICY

1.1 This Privacy Policy ("Privacy Policy") is issued by Electrolux Vietnam Co., Ltd., and its related companies (individually or collectively referred to as "AEG", "we", "us" or "our"). This Privacy Policy applies to the products, services and/or website(s) provided by AEG.

1.2 AEG is committed to protecting your privacy and personal data (in accordance with the relevant laws of Vietnam, including the Civil Code, the Law on Information Technology and the Law on Cyber Information Security, and the guiding and/or enforcement documents of the above legal instruments, as amended or supplemented from time to time ("Vietnam Personal Data Protection Laws")). This Privacy Policy explains how we collect, use, disclose and/or process your personal data. This Privacy Policy must be read in conjunction with AEG's Terms and Conditions.

1.3 AEG reserves the right to amend this Privacy Policy from time to time. We will notify you of any changes to the Privacy Policy by publishing the updated Privacy Policy on our Website at https://www.aeg-vn.com/en-vn/support/data-protection-policy/. Please check the Website or send your request by email to vncare@aeg.com if you would like to receive the latest updates to the Privacy Policy. Our Website(s) are websites and online applications.

2. INFORMATION WE COLLECT

2.1 Generally, the personal data that we collect, use, disclose, process and/or store includes your name, address (including email address) and contact details (which may include home phone number, company phone number and mobile phone number). Where a particular product or service may be relevant, we may collect personal data relating to that particular product, service or warranty repair from you. The types of personal data that we may collect, use, disclose and/or process as part of our routine operations or in the ordinary course of business and depending on the nature of the interaction with the individual in question and with the circumstances in question, include:

  • Full name, personal identification number, mobile phone/residential phone number, personal email address and/or residential address;
  • Financial data such as bank account numbers and/or credit cards;
  • Photographs, video images, or audio recordings of individuals;
  • Age or date of birth;
  • Personal preferences about the product;
  • Products and services that an individual may have purchased/requested along with any data necessary for the delivery, repair and maintenance of such products and services or to respond to requests;
  • Data relating to individuals provided directly to AEG through AEG's websites or indirectly through the use of AEG's websites, through AEG's third parties or otherwise;
  • Data provided to AEG through customer service channels, surveys, visits by and to AEG representatives from time to time;
  • Data from access to or use of AEG's premises, utilities and/or resources;
  • Access data, pixel tags, pixel techniques, IP addresses, and navigation data.


2.2 The information we collect from you when you interact with us online depends on the tasks you complete on the Site, the products or services you receive from us and/or your interactions with us. From time to time, you may interact with us anonymously or through a pseudonym.

2.3 You are under no obligation to provide any personal data at our request. However, if you choose not to provide us with certain personal data, we may not be able to address your request, and/or may not be able to provide you with products or services that are subject to our ability to collect, use, disclose or process, or products or services that require your personal data. We may also be unable to respond to your requests or instructions in the absence of your personal data.

(I) ACCESS TO OUR WEBSITES AND USE OF OUR PRODUCTS

2.4 When you visit and visit our Website or use our products, we collect data for statistical and maintenance purposes to enable us to evaluate the effectiveness of our Website or products. General information includes:

  • the number of users who visit our Website or use our products and the number of pages viewed;
  • the date, time and duration of the visits; and
  • links through our Website.


The above information will not identify you and we will not combine it with any other information in a way that we may identify you.

2.5 When you interact with us on matters in which case your personal data is reasonably required by us to process your interaction, request or activity, we will need to obtain personal data from you in order to complete such interaction, such as your online application for information about our products or services and/or registration of our products or services that you have or are receiving from us ("Product Registration"). When completing the Product Registration process or requesting other product or service information, or when using the contact us function on our Website, you may need to complete an online form on the Website. Our online forms will ask you to provide personal data and such personal data will/may be collected, used, disclosed and/or processed by us for one or more Purposes (as defined below) and/or any other purposes set out in such form. You will have the right to choose whether or not to provide personal data, although if certain personal data is not provided to us will mean that we are unable to process your request or transaction in question.

2.7 The Website is not intended for use by any person under the age of 18. We do not, and do not intend to, transact directly through the Website with, nor do we sell or ship any items ordered directly through the Website to, anyone we know to be under the age of 18. If you are under the age of 18, you should only use the Website under the direction of and through your parent or guardian, and should not submit any personal data to us. By providing any personal data to us, you confirm that you are at least 18 years of age or older and agree to the terms set out in this Privacy Policy.

3. HOW WE COLLECT PERSONAL DATA

3.1 AEG collects personal data in a variety of ways, including but not limited to the following:

  • when you request information relating to a product that interests you, fulfill other requests, or order our products or services;
  • when you interact with us in ways such as through customer call centres or with our technicians during our visit to the Website, or through your access to and use of the Website, or our online services and telephone exchanges;
  • when you purchase or register a warranty for AEG products and/or services;
  • when you attend an event, participate in a contest or a promotion organised or conducted by us;
  • when you register your purchase so that you can receive all the benefits that your purchase entitles you;
  • when you fill in your personal details on our website (e.g. when you sign up to receive our newsletter), when you provide information by fax or by telephone or in writing such as a warranty registration form;
  • when you provide feedback about our products or services, or when you complete any registration forms, orders, questionnaires or surveys, or participate in our contests;
  • when you engage with us via social media, for example posting on our Facebook page;
  • from third parties such as our related companies, contractors and agents;
  • from publicly available sources of information;
  • from memorandums relating to the use, service and repair of your AEG products;
  • when you provide us with your personal data; and
  • from our other Websites.


3.2 Any information that is not capable of identifying you, such as the number of users who visit this Website, is collected through the code embedded in the pages of this Website. You cannot disable the code on these pages.

3.3 Other information, such as browser type, is included in a "cookie" (access data). Cookies are information that a website can transfer to a personal computer's hard drive to keep a record. Cookies make it easier to use our Website by storing information about your choices on a particular website. This will allow you to get the most out of the services offered to you. We are not responsible for the content or privacy practices of such third-party websites.

4. PURPOSES OF COLLECTION, USE, DISCLOSURE AND PROCESSING OF YOUR PERSONAL DATA

4.1 AEG will/may collect, use, disclose and/or process your personal data for one or more of the following purposes:

(a) monitor, process and/or monitor your use of the Site in order to provide you with a seamless experience, facilitate or manage your use of the Site, and/or assist us in enhancing your experience of using the Site;

(b) assess and process your request for a purchase and/or subscription to our products and/or services;

(c) processing payments in connection with your purchase of our products and/or services (including but not limited to repair and maintenance work carried out on the products);

(e) manage, facilitate, process and/or settle your relationship with us, any transactions or actions taken by you on the Website or at our retail stores. This includes processing your applications, orders and payment transactions; making transactions and providing you with the products and/or services you have requested. Without limiting the generality of the foregoing, if you make a purchase and the item is delivered to a third-party recipient, you consent to us disclosing personal information that identifies you to the aforementioned third-party recipient (e.g., your name and other information). Further, you acknowledge and agree that the delivery of the item for which you have paid may include the disclosure of certain personal data about you in order to make the delivery, e.g. name and contact details, which may be disclosed on the packaging of the parcel, on the envelope or a document relating to the delivery, as the case may be, which may be seen by the third party viewing the parcel, envelope or document mentioned above;

(f) carry out your instructions or respond to any request made by (or purported to be made by) you or on your behalf including responding to your customer service requests and complaints; or responding to or addressing your interaction with us;

(g) communicate or communicate with you via telephone/voice call, text message and/or fax message, email and/or postal mail for the purpose of administering and/or administering your use of the Website, your membership and/or account with us, your relationship with us or any transaction you have with us. Please do not provide us with your Feedback if you do not want your Feedback to be made public. If you wish to provide us with Feedback and do not want it to be made public, please send an email to our Customer Care Department at vncare@aeg.com address and include the word "Confidential" at the beginning of your email subject line;

(j) understand your interests, interests and preferences;

(k) comply with or enforce the terms and conditions of any contract or agreement entered into by or on behalf of AEG (and/or its related entities) to which AEG (and/or its related entities) is bound or obliged to abide;

(l) identify you and assist you in your use of our website products, services and services;

(m) for marketing purposes and in connection with this, we may provide you with marketing, advertising and promotional information, materials and/or profiles relating to products, contests, services and/or events (including products, contests, services and/or events by third party entities with which AEG may cooperate) that AEG (including AEG affiliated/related companies) or such third party entities may sell, market, offer, organise, participate in or promote, whether such products, services and/or events are ongoing or will be created in the future:

(i) by phone calls/voice calls, faxes, postal mail, push notifications, other forms of notifications in the phone application or the exploitation of other technologies (e.g. geolocation technologies) for our mobile application(s) ("Application") on your mobile device(s) or other technologies on your computers, and/or through other communication methods other than those set forth in paragraph (ii) below, in accordance with applicable Vietnam Personal Data Protection Laws. You may opt out or opt out at any time by emailing our Data Protection Officer. For the avoidance of doubt, your registration or acceptance or permission to this Privacy Policy constitutes your consent to this subsection (i); and

(ii) if you explicitly and separately consent to being contacted by email or via text message to your Vietnamese mobile phone number, in accordance with the requirements of the applicable Vietnamese Personal Data Protection Laws.

For the avoidance of doubt, this subsection does not affect subsection(s) below that you hereby consent to us contacting you for a survey, which you may later opt out of by sending a notice to our Data Protection Officer;

(n) carry out special screening or other screening activities (including background checks) in accordance with legal or regulatory obligations (whether Vietnamese or foreign) applicable to us or our affiliates/affiliates, requirements or guidelines of government authorities (whether Vietnamese or foreign) that we determine apply to us or our affiliates/affiliates, and/or our risk management procedures which may be required by law (whether Vietnamese or foreign) or may be put in place by us or our affiliates/affiliates;

(o) prevent or investigate any fraud, illegal activity or omissions or misconduct, whether or not there is any suspicion of the foregoing; handle conflicts of interest; or handle and/or investigate complaints;

(p) to comply with or as required by any applicable law, court order, regulatory order, governmental or statutory requests, or any jurisdiction that applies to us or our affiliates/affiliates, including meeting disclosure requirements under the requirements of any law binding on us or our affiliates/affiliates, and/or for the purposes of any guidelines issued by competent authorities or other authorities (whether in Vietnam or other countries), to which we or our affiliates/affiliates are deemed to be subject;

(q) comply with or pursue any request or direction of any government agency (whether Vietnamese or foreign) to which we are deemed to be subject; or respond to requests for information from public authorities, ministries, operational departments or other similar authorities (whether Vietnamese or foreign). For the avoidance of doubt, this means that we may/will disclose your personal data to the above-mentioned organisations at their request or direction;

(r) conduct research (including customer research), surveys, market surveys, analysis and/or development activities (including but not limited to data analysis, surveys and/or profiling) to improve the quality of our services and facilities, or to improve our understanding of your interests, interests and preferences, to enhance any ongoing interaction between yourself and us in connection with or in connection with the Site, or to improve any of our products or services. Without limiting the generality of the foregoing, in this regard, we may/will send you surveys or request a survey via face-to-face or telephone interview, by email or postal mail;

(s) store, store, backup (whether for disaster recovery or other purposes) of your personal data, whether in or outside Vietnam;

(t) facilitate, process and/or administer independent audit(s) or internal audit(s) of AEG's business or its affiliates/related companies;

(u) to prepare reports in relation to our dealings with you, and/or to generate statistics and research of such transactions for internal reporting and/or statutory reporting and/or in accordance with record-keeping requirements;

(v) maintain and develop our business systems and infrastructure including testing and upgrading such systems;

(w) process and/or facilitate a business asset transaction or a potential business asset transaction, in which AEG is a participant, or a related business or an AEG affiliate is a participant, or AEG and/or one or more related businesses or any of AEG's affiliates are parties(s), and may have third party entities as parties to such transaction. "Business Asset Transaction" means the purchase, sale, lease, merger or consolidation or any acquisition, assignment or financing of an entity or part of an entity or any business or assets of an entity;

(x) the anonymization of your personal data. In this regard, you acknowledge that such anonymized personal data is no longer personal data and that the requirements of applicable domestic data protection legislation will no longer apply to such anonymised data;

(y) the reporting purposes of AEG, the Electrolux Group Companies or AEG's parent companies including but not limited to reporting on AEG's business ("Electrolux Group Companies" means AEG, its affiliates, related companies and affiliates worldwide); including the creation of statistics and internal reporting and/or statutory reporting and/or in accordance with the record-keeping requirements of AEG or AEG's affiliates/related companies; and/or

(z) to dispose of, or as part of, a bankruptcy, dissolution, reorganization, restructuring, insolvency, asset management or transfer for the benefit of AEG's creditors.

(the foregoing purposes are collectively referred to as the "Purposes").

4.2 In relation to the marketing purposes at paragraph 4.1(n)(i) above, you may notify us at any time that you no longer wish to receive any marketing communications and opt out of receiving specific communications by responding through the channel through which you received marketing communications, or by contacting us at the contact address below. If you have installed a phone application and you wish to stop receiving push notifications, you may do so by changing the settings on your mobile phone or in the phone application.

4.3 For the avoidance of doubt, you acknowledge and consent to AEG sharing anonymized information with third parties. For the avoidance of doubt, Vietnam's Personal Data Protection Law does not apply to anonymized data that does not identify the individual, and Vietnam's Personal Data Protection Law does not give you the right to object to an organization's handling or processing of anonymized data.

5. HOW YOUR PERSONAL DATA IS STORED, USED, AND MANAGED

5.1 AEG pays special attention to the protection of your privacy. In this regard, we will take reasonable measures to ensure that your personal data is kept confidential and secure, and take appropriate technical and organisational measures to protect your personal data from unlawful or accidental destruction, loss of risk, collection, use, disclosure, access, copying, modification, leakage, destruction, unauthorised alteration or other forms of unlawful processing.

5.2 Any information provided to us on the Website will be protected by Secure Sockets Layer protocols.

5.3 When we transmit information from our servers to our mainframes, we use all reasonable efforts to ensure that this is done in a secure manner. Access to our mainframes is protected by firewall security systems upon request, subject to the risk of the information stored. In addition, the Website has an Internet Detection System to monitor for potential security and security threats.

5.4 All information stored in writing or on AEG's systems is protected from unauthorized access by the use of multiple security procedures including user passwords.

5.5 Please note that the transmission of data over the internet is never absolutely guaranteed, and while we use every effort to secure and protect information, we cannot guarantee the security of any information provided by you or transmitted to us. Any provision of such information is at your own risk.

5.6 We will also put in place measures so that your personal data in our possession or under our control will be destroyed and/or anonymized as soon as it is deemed that (i) the purpose for collecting such personal data is no longer for the retention of such personal data; and (ii) the retention is no longer necessary for any legal or business purpose.

6. DISCLOSURE OF PERSONAL DATA

6.1 AEG may/will need to disclose your personal data to third party organisations other than AEG including AEG's affiliated companies, and these organisations may be located in (and your personal data may be disclosed in) abroad and outside of Vietnam, for one or more of the above Purposes, whereby these third parties will process your personal data for one or more of the above Purposes. In this case, you hereby acknowledge, agree and agree that we are permitted to disclose your personal data to these third parties (whether third parties located in or outside Vietnam) for one or more of the above Purposes and for these third parties to accordingly collect, use, disclose and/or process your personal data for one or more of the above Purposes. This disclosure is made in accordance with appropriate privacy and security protections. Third party organisations to whom we commonly disclose your information include:

  • third-party organisations hired by AEG to assist us in providing services to you including transportation, installation, maintenance and repair;
  • suppliers, agents and other third parties with whom we have commercial, business, marketing and related purposes including but not limited to those who provide us with administrative or other services such as mail services, telephone switchboards, telecommunications companies, banks, logistics companies, information technology companies or software and data center companies;
  • providers of market research, marketing and/or telemarketing services;
  • our professional advisors, for example, auditors and lawyers, as well as insurance companies;
  • governments, regulators or other organisations that require us to disclose your personal data by law;
  • our related companies, affiliates and product partners, including but not limited to when we receive product criticism or complaints, for example, our contract manufacturers, logistics service providers or other third parties in the supply chain, which may be located overseas, depending on where the product or related part is manufactured;
  • any authorized or proposed transfer of AEG's actual business, or of a merged entity in the event that AEG is merged to form such merged entity;
  • third parties disclosed by AEG for one or more Purposes and these third parties will in turn collect and process your personal data for one or more Purposes.


6.2 We may disclose your personal data to foreign members of AEG's group of companies (and their partners), who may contact you about certain products or special offers, for one or more of the above Purposes.

6.3 We may disclose your personal data to a seller or a successor entity in connection with the sale of AEG or a related company, or a business unit owned by AEG or a related company, or the sale of all assets of AEG or a related company.

6.4 When your personal data is removed from Vietnam, we will comply with the requirements of Vietnam's Personal Data Protection Laws to do so. In this case, this includes taking appropriate steps to ensure that the overseas recipient of personal data is bound by legally enforceable obligations so that personal data is transferred under a standard of protection that is at least equivalent to the protection under Vietnam's Personal Data Protection Laws.

7. PROVISION OF THIRD PARTY PERSONAL DATA BY YOU

7.1 When you provide AEG with the personal data of an individual(s) other than you, you represent and warrant to AEG and you hereby confirm that:

(a) prior to disclosing such personal data to us, you have obtained the consent of the individuals to whom the personal data is being disclosed to us, to:

(i) allow you to disclose the personal data of individuals to AEG for the Purposes; and

(ii) authorize AEG to collect, use, disclose and/or process individuals' personal data for the Purposes, as set out in paragraphs 4 and 6 above;

(b) any personal data of individuals that you disclose is accurate;

(c) you are duly acting on behalf of such individuals and you have their authorization to provide their personal data to AEG and for AEG to collect, use, disclose and process such personal data for the Purposes set out in paragraphs 4 and 6 above; and

(d) the terms of this Privacy Policy have been known to and agreed to by these individuals.

8. ACCESS AND CORRECTION OF PERSONAL DATA OR WITHDRAWAL OF YOUR CONSENT

8.1 AEG takes reasonable steps to ensure that any personal data collected, disclosed and used by us is accurate and complete if we are capable of using your personal data to make a decision that affects you, or to disclose it to another organisation. However, it is important that you let us know about any changes to your personal data or if there are any errors in the personal data we hold about you. We are not responsible for relying on inaccurate or incomplete personal data arising from your failure to update us of any changes in your personal data as you originally provided to us.

8.2 Subject to certain exceptions under the law, everyone who has provided personal data will have the right to access or correct such personal data. For security reasons, you will be required to make any request to access or correct your personal data in writing. You can access or correct your own personal data by contacting our Data Protection Officer at the address below. We need sufficient information from you to prove your identity as well as the nature of your request in order to address your request.

8.3 AEG may charge a fee for processing your request to access your personal data to cover reasonable administrative costs and will notify you in this case.

8.4 For personal data access requests, when we have sufficient information from you to resolve the request, we will seek the relevant personal data to provide to you within the period required by the applicable Vietnam Personal Data Protection Laws. If we are unable to respond to you in a timely manner, we will notify you of the shortest possible time for us to provide the requested information.

8.5 With respect to a request for rectification of personal data, when we have sufficient information from you to resolve the request, we will deal with your request in accordance with Vietnam's Personal Data Protection Laws, including the correction of your personal data within the time limit required under such laws. If we are unable to complete the rectification within the stipulated timeframe, we will notify you of the earliest actual time by which we can make the correction.

8.6 You may withdraw your consent to the collection, use and/or disclosure of your personal data in our possession or control by sending a request to the email address below. We will process your request within a reasonable time from the time of the request to withdraw consent, and will subsequently not collect, use and/or disclose your personal data in the manner described in your request, unless we are permitted to do so by law or the Personal Data Protection Law of Vietnam. However, the withdrawal of your consent may result in certain legal consequences arising from this withdrawal. In that case, subject to the extent of withdrawal of consent to our processing of your personal data, this means that we may not be able to complete the transaction you have entered into with us or continue our relationship with you, or send you the information you have requested, as the case may be.

9. HOW TO MAKE A COMPLAINT ABOUT THE POLICY

9.1 If you have any concerns about our handling or processing of your personal data, or if you believe that your privacy has been compromised, please contact us by writing to the Data Protection Officer describing the content of your complaint at the address below.

9.2 We will investigate your complaint and endeavour to respond to you within a reasonable time from receipt of your complaint.

11. GENERAL PROVISIONS

11.1 Your consent to this Privacy Policy is in addition to and does not replace any other consent you have given to AEG in relation to the processing of your personal data.

11.2 For the avoidance of doubt, where applicable domestic data protection legislation permits an organisation, such as us, to collect, use or disclose your personal data without your consent, the permission under this law will continue to apply.
